SUBJECT: Colorado Springs Municipal Court House Self-Evaluation

1. On 09/07/2024, Title II ADA / Section 504 Coordinator(s) from the Office of Accessibility performed a Title II - Americans with Disabilities Act (ADA) Self-Evaluation. This evaluation was performed in accordance with 1991/2010 ADA Standards for Accessible Design.

2. Priorities for removing barriers are assigned in accordance with the ADA Checklist for Existing Facilities, promulgated by the ADA National Network. The checklist follows the four priorities listed in the Department of Justice ADA Title III regulations. These priorities are equally applicable to state and local government facilities:

Priority 1 - Accessible approach and entrance
Priority 2 - Access to goods and services
Priority 3 - Access to public toilet rooms
Priority 4 - Access to other items such as water fountains and public telephones

3. Corrective actions to findings were / will be submitted to the City maintenance work request system and will be managed in accordance with the City Transition Plan. Note: Recommended corrections may be modified where appropriate. Corrections are developed in consideration of the “Program Access” provisions of Title II, where applicable.

The width of the space is only 12’-4”. The access aisle is not marked and the space lacks accessible signage with ISA. The cross slope is 3-4% but this is OK as parallel and on the street per PROWAG.

State and local governments have an obligation to make their programs and services accessible to persons with disabilities. This may or may not require the alteration, addition or construction of existing facilities which predate The Americans with Disabilities Act (ADA) of 1990.

Under the Code of Federal Regulations Section 35.151(b)(2) State and Local Government Title II entities may provide programmatic access where alterations to existing facilities would result

Advisory R302.6 Cross Slope. The cross slope requirements in R302.6 apply to sidewalks and other pedestrian circulation paths, pedestrian street crossings and at-grade rail crossings, and pedestrian overpasses and underpasses and similar structures (see R302.2). The cross slope of the pedestrian access route is measured perpendicular to the direction of pedestrian travel. Cross slope requirements are contained in R304.5.3 for curb ramps and blended transitions, and in R407.3 for ramps.

The door exceeds the maximum pressure to open the door.

Interior doors shall have a maximum opening force of 5 pounds.

These forces do not apply to the force required to retract latch bolts or disengage other devices that hold the door or gate in a closed position. Door closers and gate closers shall be adjusted so that from an open position of 90 degrees, the time required to move the door to a position of 12 degrees from the latch is 5 seconds minimum.

Door and gate spring hinges shall be adjusted so that from the open position of 70 degrees, the door or gate shall move to the closed position in 1.5 seconds minimum.

Where a forward reach is unobstructed, the high forward reach shall be 48 inches maximum and the low forward reach shall be 15 inches minimum above the finish floor or ground.

Wall signs identifying permanent rooms and spaces of a building shall have a horizontal format with the characters raised 1/32 inch minimum and shall be sans serif uppercase characters a minimum of 5/8 inch and a maximum of 2 inches high. Contracted Grade 2 Braille shall be in a horizontal format and shall be placed a minimum of 3/8 inch and a maximum of 1/2 inch directly below the tactile characters; flush left or centered. Dots shall be 1/10 inch on center in each cell with 2/10-inch space between cells, measured from the second column of dots in the first cell to the first column of dots in the second cell. Dots shall be raised a minimum of 1/40 inch above the background. Braille dots shall be domed or rounded. Signs with raised characters or Braille shall be located 48 inches minimum above the finish floor or ground surface, measured from the baseline of the lowest tactile character and 60 inches maximum above the finish floor or ground surface, measured from the baseline of the highest tactile character.

Interior doors shall have a maximum opening force of 5 pounds.

These forces do not apply to the force required to retract latch bolts or disengage other devices that hold the door or gate in a closed position. Door closers and gate closers shall be adjusted so that from an open position of 90 degrees, the time required to move the door to a position of 12 degrees from the latch is 5 seconds minimum.

Door and gate spring hinges shall be adjusted so that from the open position of 70 degrees, the door or gate shall move to the closed position in 1.5 seconds minimum.
